Summary

The applicant should file the application at the Plant Varieties Protection Office in (Agricultural Research Center). After that, the Plant Varieties should be subjected to the DUS Test for two years, in order to examine the Novelty Distinctness, Uniformity and Stability of the new plant varieties.

If the breeder has registered/ protected the plant varieties in his country and has the DUS test document, he would be required to provide us with this document.

The Competent Office issues its decision, whether with acceptance or refusal, if acceptance, the office will publish the acceptance decision.

A variety shall be considered new if, at the filing date of the application, the vegetation propagation of the variety was not sold or otherwise transmitted to third parties by the breeder or with his consent for the exploitation of the variety. A variety shall not lose its novelty if it was exposed or circulated in Egypt for more than one year prior to the effective filing date of the application.

Where a variety has been exposed or circulated outside Egypt, such period shall not exceed six years in case of trees and vines or four years of other crops.

The term of protection for plant varieties shall be 25 years for trees and vines and 20 years for other crops. The term of protection shall run from the date of grant.

If the breeder has registered/protected the plant varieties in his country and has the DUS test documents, he would be required to provide us with this document, in order not to perform the DUS test in Egypt

Requirements
1- A Power of Attorney legalized up to the Egyptian Consulate.

2- Certificate of DUS or VCU test, which is issued from the client's country (if any).

3- 150 GMs as a sample from Plant Variety (The amount is changed from plant variety to another, according to its kind, like vegetables, fruits … etc).

4- The technical specifications of the genera/species.
